Terms of Use and Sale

1. Acceptance of Terms

By downloading, installing, or using the ThinkFood application (the "App") or the thinkfood-app.com website (together, the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

2. Description of Service

ThinkFood is a nutrition-tracking application that uses artificial intelligence to estimate the nutritional value of meals from photos, text descriptions, or voice dictation. Estimates are provided for informational purposes only and do not constitute professional medical or dietary advice.

ThinkFood also offers badges and cosmetic rewards. Badges, frames and other rewards are virtual: they have no monetary value, cannot be exchanged or transferred, and may be removed in case of fraud (false data, multiple accounts, circumventing the rules).

3. User Account

You must create an account to use the Service. You are responsible for keeping your credentials confidential and for any activity under your account. You must be at least 16 years old to use ThinkFood.

4. Pro Subscription

ThinkFood offers an optional paid subscription ("Pro") that unlocks additional features, billed monthly or annually depending on the plan chosen at purchase. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period, from your Apple account settings. Payment is charged to your Apple ID when the purchase is confirmed and processed by Apple, whose refund terms apply. Prices shown in the App Store include applicable taxes and may vary by region. The features included in Pro and their limits are described in the App (Pro screen) and on the Pricing page of the website. Your right of withdrawal is described in article 5.

5. Right of Withdrawal

If you are a consumer, you have 14 days from the day you subscribe to Pro to withdraw from the contract, without giving any reason (articles L.221-18 et seq. of the French Consumer Code; Directive 2011/83/EU).

To exercise this right, tell us your decision in an unambiguous statement sent to contact@thinkfood-app.com (you may use the model form below, but you don't have to). Because the purchase is processed by Apple, you can also request a refund at https://reportaproblem.apple.com. We will acknowledge receipt of your request.

Immediate performance: by subscribing, you ask for access to the Pro features to start right away, before the withdrawal period ends. If you withdraw after you have started using them, you pay an amount proportionate to what was provided up to the moment you told us you were withdrawing (article L.221-25). You lose your right of withdrawal if the service has been fully performed before the end of the period, with your prior express consent and your express acknowledgement that you lose this right (article L.221-28, 1°).

Refund: we will refund you no later than 14 days after the day we are informed of your decision, using the same means of payment as for the purchase (the refund goes through Apple).

You can also cancel the automatic renewal at any time from your Apple account settings (see article 4).

6. Acceptable Use

You agree not to: use the Service for unlawful purposes, attempt to access other users' systems or accounts, reverse-engineer or attempt to extract the App's source code, circumvent the daily usage limits, cheat to earn badges (false data, multiple accounts), or use the Service in any way that could damage or disrupt it.

User content: the captions, comments and photos you share with your buddies must respect others. We do not accept hateful, harassing, sexually explicit, violent, illegal or unwanted content (spam, scams).

Reporting and moderation: you can report a post or a comment from within the app (flag icon) and remove or mute a buddy at any time. We review reports within 24 hours. Content that breaks these rules may be removed and its author's account suspended or closed. You can also write to us at contact@thinkfood-app.com.

7. Accuracy of Nutritional Estimates

AI-generated calorie and macronutrient estimates are approximate and may vary depending on photo quality, the description provided, and the nature of the dish. ThinkFood does not guarantee the absolute accuracy of these estimates. The same applies to the AI assistant's answers, which may be incomplete or inaccurate. The Service is not a substitute for advice from a healthcare professional, particularly in cases of medical conditions, eating disorders, or specific nutritional needs.

8. Intellectual Property

The App, its content, features, and branding are the property of ThinkFood and are protected by intellectual property law. You retain ownership of the content you upload (meal photos), but grant us a limited license to process it as part of the Service.

9. Termination

You may delete your account at any time from the App. We reserve the right to suspend or terminate your access to the Service in case of a breach of these terms.

10. Limitation of Liability

The Service is provided "as is". To the extent permitted by law, ThinkFood shall not be liable for any indirect damages arising from use of the Service, including any dietary or health decisions made based on information provided by the App. Nothing in these terms limits the rights you hold by law, including the legal guarantee of conformity that applies to digital content and services (articles L.224-25-1 et seq. of the French Consumer Code).

11. Changes

We may modify these terms at any time. Significant changes will be notified via the App or by email. Your continued use of the Service after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by French law. Subject to the mandatory consumer-protection rules of your country of residence, any dispute falls under the jurisdiction of French courts.

13. Consumer Mediation

If you are a consumer and a dispute with ThinkFood was not resolved after a written complaint sent to contact@thinkfood-app.com, you may refer it free of charge to the consumer mediator we are attached to (articles L.611-1 et seq. of the French Consumer Code):
